1. Acceptance of Terms

By accessing and using Somehow I Will Remember ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Somehow I Will Remember is a reminder service that syncs with your Google Calendar and Gmail to detect birthdays, anniversaries, and travel plans, then sends you SMS text message reminders. The Service allows you to:

Sync your Google Calendar to automatically detect birthdays, anniversaries, and travel events
Scan your Gmail to identify contacts and their locations for travel matching
Connect your Meta (Facebook) account to access friend information (optional)
Receive SMS text message reminders for upcoming birthdays, anniversaries, and travel
Get travel reminders that match your trips with friends in those cities
Customize reminder settings including timing, frequency, and message templates
Manage your contacts, reminder preferences, and travel settings

3. User Accounts and Registration

To use the Service, you must:

Be at least 18 years of age or have parental consent
Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate, current, and complete
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account

4. SMS Text Messaging Service

4.1 Consent to Receive SMS Messages

By providing your phone number and checking the consent checkbox, you expressly consent to receive SMS text messages from Somehow I Will Remember at the phone number you provide. You understand that:

Message frequency varies based on your reminder settings and the number of birthdays in your calendar
Message and data rates may apply according to your mobile carrier's plan
You are not required to consent to receive SMS messages as a condition of purchasing any goods or services
You can opt out at any time by replying STOP to any message

4.2 Opt-Out Instructions

You may opt out of receiving SMS messages at any time by:

Replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message
Updating your preferences in your account settings
Contacting us directly at the support email provided below

After opting out, you will receive a confirmation message, and we will stop sending you SMS messages. You may opt back in at any time by replying START or updating your preferences.

4.3 Help and Support

For help with SMS messages, reply HELP or INFO to any message, or contact us through your account settings.

4.4 Carrier Limitations

Somehow I Will Remember is not responsible for any carrier limitations, including but not limited to message delivery failures, delays, or charges imposed by your mobile carrier. Standard message and data rates apply as determined by your mobile carrier.

5. Subscription Plans and Payment

5.1 Subscription Tiers

Somehow I Will Remember offers the following subscription plans:

Unlimited Plan: $8 per year - Includes unlimited SMS reminders

5.2 Payment Terms

By subscribing to a paid plan, you agree to:

Pay the subscription fee in advance for the selected billing period
Provide accurate payment information
Authorize us to charge your payment method for renewal fees
Accept that all fees are non-refundable except as required by law

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

5.4 Refunds

All subscription fees are non-refundable. Refunds may be provided at our sole discretion or as required by applicable law.

6. Third-Party Integrations

6.1 Google Calendar and Gmail Integration

By connecting your Google account, you authorize Somehow I Will Remember to:

Read your calendar events to detect birthdays, anniversaries, and travel events
Scan your Gmail messages to identify contacts and extract location information
Access calendar and email data necessary to provide the Service
Match travel events with contacts based on location data from emails and calendar

You may revoke this access at any time through your Google Account settings or by disconnecting the integration in your Somehow I Will Remember account settings.

6.2 Meta (Facebook) Integration

By connecting your Meta (Facebook) account, you authorize Somehow I Will Remember to:

Access your friend list and friend information (with your permission)
Access your location information (if provided)
Use friend and location data to enhance travel reminder matching

Meta integration is optional. You may revoke this access at any time through your Meta account settings or by disconnecting the integration in your Somehow I Will Remember account settings. We comply with Meta's Platform Terms and Data Use Policy.

7. User Content and Data

You retain ownership of all data you provide to the Service, including birthday information, calendar data, email contacts, and travel information. By using the Service, you grant Somehow I Will Remember a limited license to:

Store and process your data to provide the Service
Access your Google Calendar and Gmail as necessary to detect birthdays, anniversaries, and travel events
Scan and analyze email content to identify contacts and extract location information
Access your Meta account data (if connected) to enhance contact matching
Match travel events with contacts based on location data
Send SMS reminders based on your preferences

We do not sell your personal data to third parties. We use your data solely to provide the Service, including travel reminders and contact matching. See our Privacy Policy for more information.

8. Prohibited Uses

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful, offensive, or illegal content
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Use the Service for any commercial purpose without our express written consent

9. Service Availability and Modifications

We reserve the right to:

Modify, suspend, or discontinue the Service at any time
Update features and functionality
Change subscription plans and pricing with reasonable notice
Limit or restrict access to the Service

We will make reasonable efforts to notify users of significant changes to the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMEMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Somehow I Will Remember, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

Your right to use the Service will immediately cease
We may delete your account and data
You remain responsible for any charges incurred prior to termination

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
